Die erste Bekanntschaft mit den Ideen Fichtes in der Ukraine erfolgte gleich zu Anfang des 19. Jahrhunderts. Neue Impulse erhielten die Aneignung und Auseinandersetzung mit seinen Gedanken mit der Eröffnung der Universität in Charkow im Herbst 1804. Dank der Berufung des ehemaligen Jenaer Extraordinarius Johann Baptist Schad wurde die Universität Charkow im ersten Drittel des 19. Jahrhunderts zur Hauptstadt der Fichte-Forschungen und Kritik, nicht nur in der Ukraine, sondern im ganzen Russischen Reich. Schad, der als erster Philosophieprofessor Charkows dort bis (...) zum Dezember 1816 lehrte, gründete auch eine »Charkower philosophische Schule«, deren Vertreter verschiedene Lehrstücke Fichtes, aber auch der kritischen Philosophie insgesamt rezipierten und sich mit ihnen auseinander setzten und sie eifrig verbreiteten. Primeiramente, analisaremos a estrutura da ação humana como apresentada por Aristóteles. Posteriormente, mostraremos como algumas dificuldades enfrentadas pelo filósofo recebem uma nova solução na obra de Santo Tomás. Esta nova solução poderá ser vista como o divisor entre estes dois filósofos no que concerne a questões morais e políticas.

The article tries to prove the necessity and demonstrates the possibility of application of the methods of praxiology to ethical questions. The result is an ethical praxiology conceived as a theory of making best moral choices by moral agents. It is meant to be a practical science invented for the regulation of the process of decision-making and decision implementation.

Richard A. Posner's two books on the financial crisis focus on possible macroeconomic (Keynesian) causes of it, neglecting legal causes that would have had only microeconomic effects, yet could have been responsible for the crisis. Specifically, Posner accepts too readily the conventional wisdom that banks? leverage levels, hence their capital cushions, were deregulated; this ignores Basel I, Basel II, and the Recourse rule, which internationally and (in the last case) in the United States minutely regulated not only leverage levels but (...) the composition of banks? assets. These regulations penalized banks for making business loans in comparison to mortgage loans, and it further penalized them for keeping mortgage loans rather than selling them for securitization and then buying back the ?senior? tranches of the resulting mortgage-backed securities. These regulations may explain the overconcentration of mortgage risk in the banks, and thus the financial crisis. (shrink)

O objetivo desse artigo é mostrar de que modo um problema no domínio da teoria contemporânea do direito suscita questões que podem encontrar esclarecimentos na filosofia de Thomas Hobbes. Para tanto, será primeiramente analisada uma decisão da Suprema Corte norte-americana que retoma um debate constitucional aberto há já quase vinte anos e que versa sobre os direitos civis1. In the article, a little-studied question of the critical interpretation of the theological position of the representative of German protestant tradition Otto Pfleiderer (1839–1908) in the eastern orthodox theology, especially in the work of Kharkiv Professor Timofej Butkevič (1854–1925), is presented. At first, the main periods of a clerical and creative career of Butkevič, including his studying at the Kharkiv Clerical Seminary (1869–1875) and the Moscow Clerical Academy (1875–1879), are considered. Then the features of the theological publications and the teaching (...) of Butkevič at Kharkiv University are pointed out. His important works were two monographs: The evil, its essence and origin (1897) and Religion, its essence and origin (1902–1904) in two books. The positions of well-known German theologians such as Karl August von Hase (1800–1890), David Friedrich Strauß (1808–1874), Karl Theodor Keim (1825–1878), Karl Philipp Bernhard Weiss (1827–1918), and others were here analyzed. But Butkevič’s critical interpretation of the theological viewpoint of Otto Pfleiderer in his two volumes work Die Religion, ihr Wesen und ihre Geschichte (1869) and in his Geschichte der Religionsphilosophie von Spinoza bis auf die Gegenwart (1883) occupies a central place in this analysis. In turn, Butkevič’s important achievement was the popularization of the ideas of Otto Pfleiderer in Russia and Ukraine, in particular, because of his translation of extracts from Pfleiderer’s works. Ao apresentar a estratégia dos agentes racionais na situação do estado de natureza em Hobbes como de não coordenação, tem-se como resultado uma situação em que a melhor escolha individual alcança o pior resultado em termos coletivos. Hampton pretende mostrar que a melhor estratégia para resolver essa aporia consiste em eliminar, na argumentação de Hobbes, o uso de conceitos jurídicos, como o de obrigação ou contrato. Desse modo, é possível resgatar a coerência argumentativa hobbesiana a partir simplesmente da ideia de (...) um acordo autointeressado, isto é, a partir da situação em que os benefícios da barganha mostram-se suficientes para as partes realizarem um acordo. O presente texto procura mostrar a incoerência de tal argumentação. Eliminar a noção de obrigação que sustenta as promessas presentes nos pactos inviabiliza, em Hobbes, qualquer possibilidade de equilíbrio e convergência das ações humanas. Há um discurso teórico que denuncia a igualdade formal presente no ideal de Estado de Direito como um manto ideológico a serviço do conservadorismo. Por debaixo desse manto, as profundas desigualdades sociais e relações de opressão seriam legitimadas como se fossem simplesmente fruto da aplicação imparcial das regras jurídicas a que todos estariam igualmente submetidos. Embora essa crítica sirva quando direcionada ao modelo de Estado de Direito defendido por Hayek, que apresenta falsamente as regras oriundas dos costumes e dos precedentes (...) como isentas de posições políticas, ela não atinge da mesma maneira o modelo de Estado de Direito centrado na supremacia da legislação. Apesar de todas as limitações que podem ser reconhecidas no ideal de igualdade formal, a sua recusa parece antes permitir novas e mais graves formas de opressão do que as suprimir. (shrink)

Poder-se-ia afirmar que os valores e ideais da modernidade conduzem à constituição das instituições do Estado Democrático de Direito. Trata-se de um longo e intrincado processo de feitura cujo resultado pode ser rastreado a partir de um complexo conjunto de visões teóricas e compromissos institucionais: princípios dos liberalismos político e filosófico, constitucionalismo e democracia deliberativa. Tal percurso revela-se acidentado, no entanto há uma presença constante entre os críticos da modernidade. Trata-se da perspectiva antiliberal de algumas posições conservadoras. Contemporaneamente, o quadro (...) das democracias ocidentais permite-nos rastrear as dimensões dessa críticatanto no que diz respeito às instituições representativas, quanto àinterpretação do papel e escopo de atuação do Direito no controle dos atos do Executivo. Ambas as posições se encontram vinculadas nos movimentos encetados por populistas plebiscitários em defesa de uma democraciailiberal. No presenteartigo, que se oferece como uma carta ou mapa de intenções para um plano de pesquisa futura, buscamos rastrear as bases de ambos os braços da crítica ao arranjo liberal das democracias constitucionais nas influências schmittianas sobre as reflexões de uma democracia iliberal parceira de um constitucionalismo do bem comum. The academic and humanitarian conception of harmonious union has been proposed by Professor Zhang Liwen in the 1990s. It claims to explain the specifics of Chinese civilization and proposes solution of some global problems by its means. Despite the lack of direct references to the conception, it remains in demand both in the political and ideological discourse of the People's Republic of China. This presentations deals with the historical and philosophical facts available in Chinese written monuments and works of Antiquity (...) and the Middle Ages, which are put forward as a justification for the primordial idea of harmonious union in Chinese culture. An attempt is done to show that this concept does not offer any new set of philosophical categories, but appeals to the well-known concepts of two-, three- and five-item classifications. At the same time, the emphasis is laid on the form, the method of combining opposite or dissimilar elements. In general, on the basis of the limited historical and philosophical material, it can be concluded that the concept of harmonious unification is aimed not so much at revising the composition of the philosophical system of Confucianism, but at rethinking its value criteria for interaction and mutual dependence of objects and phenomena. Except for scholarly works dealing with well-defined problems, writings on Byzantine art rarely fail to arouse in the reader some disquiet, some perplexity, regarding the aggregate of this art—its distinctive characteristics and essential values. The following remarks, confined to painting, are designed solely to clarify the foregoing statement, to indicate why it is justifiable, and to retrace, if possible, the genesis of such a state of affairs.

O direito público contemporâneo é pensado a partir do tratamento impessoal dos cidadãos por autoridades e funcionários que agem dentro da moldura jurídica que delimita sua competência e orienta a sua ação ao interesse público. Se a soberania for compreendida a partir do instituto da propriedade (dominium), a relação entre o Estado e o cidadão acaba por espelhar a forma da relação entre senhor e escravo, em que os súditos se encontram submetidos à vontade privada do soberano. Uma tal modalidade (...) patrimonial de Estado mostra-se incompatível com a caracterização do direito público moderno. Neste artigo, identificamos na obra de Jean Bodin o contraste entre, de um lado, o caráter público do exercício da soberania nos regimes legítimos e, de outro, a natureza patrimonial dos regimes despótico e tirânico. No pensamento de Thomas Hobbes, observamos a evolução de uma concepção meramente patrimonial da soberania presente em Elements of law e De cive para uma distinção formal entre a vontade privada e a vontade pública do soberano no Leviathan. Nossa conclusão é que ambos os autores acabam por fornecer, cada um à sua maneira, um aparato conceitual apto para lidar com as características do Estado moderno acima apontadas, cuja repercussão pode ser notada na Filosofia Política dos séculos subsequentes. A seguir, são expostas as noções de proposição, nomes positivos e nomes negativos. The article deals with the main tendencies in the studies of Russian neo-Kantianism in Poland. Although the number and quality of research in the history of Russian neo-Kantianism still cannot be equated with those of the history of German neo-Kantianism, the situation of these studies is constantly changing for the better. The authors mark the undeniable progress in the studies of Russian neo-Kantianism in Poland in the recent years: there are monographs, articles, collections, research projects on particular thinkers or themes (...) related to the history of Russian neo-Kantianism. The authors consider A. Noras’s idea of the development of neo-Kantianism into post-neo-Kantianism rather heuristic. One of the main features of this development is the ontologization of the cognitive process. This “ontological turn”, typical of Russian neo-Kantianism, in particular as represented by S. Hessen, V. Sesemann, B. Jakovenko, is, on the one hand, the hallmark of the entire Russian philosophy and, on the other, it brings together the philosophical efforts of Russian neo-Kantians and the conception of the author of the “new ontology” – N. El objetivo de la investigación es demostrar que la aplicación del Flipped Classroom mejora el nivel de logro del aprendizaje significativo en estudiantes universitarios. Para la recolección de datos en los grupos control y experimental se aplicaron dos instrumentos: el pre-test y el post-test. Concluido con la aplicación de los talleres basados en la metodología FC, en el postest se observó que en el grupo control, 26 estudiantes obtuvieron una calificación aprobatoria y 11 reprobatoria, mientras que en el grupo experimental, (...) 38 estudiantes, de acuerdo a los criterios de evaluación, todos lograron una calificación aprobatoria. Książka wybitnego znawcy problematyki filozofii, socjologii i politologii profesora i akademika Włodzimierza Kokluchina zwraca uwagę przede wszystkim czymś, co określić można mianem „pozaczasowości", a co polega na tym, że mimo swego uwikłania w konkretną rzeczywistość początku XXI wieku ogarnia ona prawidłowości rządzące polityką w procesie jej przemian w czasie. Odniesienia do konkretnych sytuacji maja tu na ogół charakter egzemplifikacji i służy głównie ukonkretnieniu rozważań dotyczących problemów poza tą konkretność wykraczających. Owa „pozaczasowość" odnosi się zresztą w równym stopniu do przeszłości, jak (...) i do przyszłości, w równym bowiem stopniu Autorowi udaje się ująć politykę jako proces wyrastający z przeszłości, jak i jako proces, który rozwijając się kształtował będzie rzeczywistość społeczną bliższej i dalszej przyszłości. Traktując politykę w ten właśnie sposób Włodzimierz Kokluchin nie traci z pola widzenia faktu, iż sama ta polityka jest czymś, co wciąż wymaga dookreślania i poznawania - jest tworem kształtowanym między innymi poprzez refleksję nad nią. This is a review of Alexandre Kojève, The Religious Metaphysics of Vladimir Solovyov, translated by Ilya Merlin and Mikhail Pozdniakov, Cham: Springer International Publishing, 2018. This slim book is a translation of Kojève’s essay “La métaphysique religieuse de Vladimir Soloviev,” which was first published in two installments in the Revue d’histoire et de philosophie religieuses in 1934. The French text was itself based on Kojève’s doctoral dissertation, Die religiöse Philosophie Wladimir Solowjews, defended in Heidelberg under the direction of Karl (...) Jaspers in 1926. The translation is accompanied by an introduction from the translators discussing translation issues. In this review, I summarize Kojève’s essay and editorialize on the issue of the principal influences on Solovyov’s metaphysics. Kojève claims that most of Solovyov’s metaphysics was in fact borrowed from Schelling and perhaps also to some extent from Jakob Böhme. If that is the case, then what is usually considered the prototypical Russian metaphysics is... not Russian. (shrink)

To desire contact with a piece of reality is to love. —Simone Weil, The Needfor Roots According to czeslaw milosz, Boris Pasternak "did not pluck fruits from the tree of reason, the tree of life was enough for him. Confronted by argument, he replied with his sacred dance." (...) Pasternak's poetry, he concludes, is "antispeculative, anti-intellectual," and though he was compelled to make certain concessions in the course of writing Doctor Zhivago, speculative thought nonetheless remained for him a perennial and decided "adversary." ' However, the familiar and conveniently stark distinction between lyricist and thinker upon which such judgments depend is in fact both naive and tiresome since, plainly, creativity and reflection need in no way necessarily subvert one another. Accordingly, while it is indeed likely that the most valued feature of Pasternak's poetry and best prose is its detailed recording ofthe world's incessant change, of the magic and movement of weather and gardens, seasons and landscapes, Milosz is far from just in so readily and categorically dismissing any attribution of poetic thought to Pasternak. For as much as the whole of his poetry amounts to a celebration of life's small wonders, unrivaled in their greatness, there remains at bottom the inspiration of the thinker, of one who has seen and felt, but who at the same time has had to compile and consider in an attempt to make sense of the whole. As if in open challenge to Milosz, CM. Bowra notes that Pasternak's poetic sensibility is "both physical and intellectual." The mental states described in his poems, Bowra writes, "begin with sensations of the eye and ear but contain something else in their mental appreciation of the 211 212Philosophy and Literature situation," namely, his "gift for grasping abstract problems." 2 If Milosz remains unconvinced, and if Wladimir Weidle dismisses Pasternak's poetic thought as "puny and piteous," still more poets and critics have shared Bowra's view.3 Henry Gifford refers to Pasternak's "philosophical habit of mind," Ronald Hingley to the "pyrotechnics" ofhis "darting intellect," and Yury Lotman to his personal and "thoroughly professional philosophical culture." 4 In her review ofPasternak's My Sister, Life, meanwhile, Marina Tsvetaeva observes that "thought is what works in him, burrows in subterranean passages...." 5 And though Nadezhda Mandelstamclaims that the word of all poets "flows from a general, integrated view of the world," she acknowledges too that poets "vary in the range and depth of their understanding" and proceeds to cite Pasternak as her one example of a poet with a particularly unified worldview.6 If we were to agree with Francis Sparshott that "the fiercest hatreds spring from the closest relationships," we could assume in turn that the fundamental antagonism customarily alleged to obtain between the creative and critical faculties in fact indicates only some common, if confused, origin or inspiration.7 In creating, after all, it is predictable rather than idiosyncratic that the artist will be led to investigate the roots ofart within himself, tiiat he will be tempted by the urge to define, to entertain, that is, some rudimentary theory. And indeed, in Pasternak 's case, it is not simply a matter of his poetry and prose having been informed by certain tacit, if stray, aesthetic conceptions, but rather of his having supplemented his intensely thoughtful artwith aconcurrently developed theory. In this article, I want specifically to consider Pasternak's conception of realism, that standard of achievement which, according to his theory, constitutes the touchstone of all great art. In order more firmly to ground this notoriously vague and unwieldy notion, I will appeal not only to complementary theoretical conceptions of Pasternak's, but also to those central ideas advanced by Iris Murdoch in The Sovereignty of Good. My intention will be to locate Pasternak's brand of realism within what I take to be an identifiable tradition, or at least a conspicuous and pervasive theoretical tendency, according to which the most crucial criterion of artistic realism is judged to be not any properly physical aspect ofthe completed work, and certainly... The crisis of the theory of socioeconomic formations has recently become clearly apparent in our social philosophy. Earlier as well, the "formational" approach, with its presumption that the new order has "decisive advantages," caused perceptible epistemological difficulties associated with the effect of "inverted perspective." It followed from the theory that socialist Mongolia, Vietnam, and Cuba were a "whole epoch" ahead of the USA and other developed countries of the West that had preserved the outmoded capitalist order.

Originally published in 1923, this title is a critical examination of Freud’s theory of psychoanalysis. A contemporary of Freud, the author sets out to evaluate his theories in a scientific manner, searching for evidence. The result is a rather scathing review of where this is lacking.

The theory and practice of advertising self-regulation have been evolving for decades in pursuit of basic standards for advertising quality. In Spain, this discipline was put into practice in 1995, the year the Association for the Self-Regulation of Commercial Communication was created. This article aims to examine in depth the functioning of the Spanish advertising self-regulation system, with special emphasis on the Advertising Jury, and explore to what extent some of the normative requirements of rigour, independence and participation can be (...) considered to have been met. The paper is based on a case study in which interviews with Autocontrol members, Jury members and consumer associations have particular bearing. The results shed light on the achievements of Autocontrol’s self-regulation work and the challenges it still faces. (shrink)

The key stakeholders of the Finnish engineering education collaborated during 2006–09 to reform the system of education, to face the challenges of the changing business environment and to create a national strategy for the Finnish engineering education. The work process was carried out using participatory work methods. Impacts of sustainable development (SD) on engineering education were analysed in one of the subprojects. In addition to participatory workshops, the core part of the work on SD consisted of a research with more (...) than 60 interviews and an extensive literature survey. This paper discusses the results of the research and the work process of the Collaboration Group in the subproject of SD. It is suggested that enhancing systematic dialogue among key stakeholders using participatory work methods is crucial in increasing motivation and commitment in incorporating SD in engineering education. Development of the context of learning is essential for improving skills of engineering graduates in some of the key abilities related to SD: systemic- and life-cycle thinking, ethical understanding, collaborative learning and critical reflection skills. This requires changing of the educational paradigm from teacher-centred to learner-centred applying problem- and project-oriented active learning methods. (shrink)

The main idea that we want to defend in this paper is that the question of what a logic is should be addressed differently when structural properties enter the game. In particular, we want to support the idea according to which it is not enough to identify the set of valid inferences to characterize a logic. In other words, we will argue that two logical theories could identify the same set of validities, but not be the same logic.

It is commonly accepted by those who consider macroevolution as a process decoupled from microevolution that its apparent jerkiness (and, hence, incompatibility with principles of population genetics) results from the structural complexity of epigenetic systems, since all complex cybernetic systems are expected to behave discontinuously. To analyse the validity of this assumption, the process of self-improvement has been analysed in a complex cybernetic system by means of computer simulations. It turns out that the investigated system tends to develop by accumulation (...) of as small structural changes as possible, while larger changes are likely to result in the collapse of the system rather than in its persistence or improvement. This implies that cybernetic considerations alone cannot justify the claim that the very nature of epigenetic systems induces evolution by discrete steps rather than by gradual accumulation of small changes.
